Reasons We File For
Bankruptcy – Why Do People Declare
Bankruptcy?
Bankruptcy
is a legal term that all of us have heard many times before. We
typically would think that a person has become poor when
they're bankrupt however that is generally not even close to
the case. So what are the reasons why people file for
bankruptcy? We have this pre-conceived notion that if we become
bankrupt, we're irresponsible and lazy. In the real world, it
could be one of the most responsible actions that a person
could decide to take when it is actually necessary. It isn't an
easy choice for most people to make, but it is the best one for
certain situations.
When you
begin declaring that you are bankrupt, what you are practically
saying to your creditors is that you cannot possibly ever repay
all of your debt.
You will need to declare bankruptcy through a
lawyer. If it so
happens that your situation is a valid one, you will then be
freed of your debt. When this happens, all the
companies that you owe money now will have no right to ask for
it. This might
sound really good at first; however, it does have its draw
backs as well.
Allow me
to tell you one thing though; having a bankruptcy show on your
credit report for the next six to 10 years will not be even
close to beneficial to you. It will sit there in large,
bold, red letters in your credit report for a really long
time. As a result
of it, you will have difficulty getting credit cards, loans or
making big purchases although ironically, these may be the very
things that cause you to declare bankruptcy to begin
with. If you could
prove that you're making some real strides with your financial
situation, you can find it less hard to get financing but not
very.
Still, it
is a real nice way of taking financial responsibility of your
own life. Not to
mention, you will feel a really big burden being raised off
your shoulders.
Credit
card companies and other creditors where you owe money in fact
have the right to say no to your bankruptcy
claim. There
are certain situations when they are very likely to do
this also.
If you just went a vacation, made a large purchase, used
a credit card while unemployed or spent money after
consulting with a lawyer, you will appear to be
suspicious in their eyes and will likely be
denied. It
is always best to consult a lawyer or debt counselor
before you actually take the plunge and declare
bankruptcy.
